General Sales Conditions
1. Definitions
In these Terms and Conditions of business the following meanings shall apply:
- "Company" shall mean Edelweiss DR AG (hereinafter also referred to as "Edelweiss DR"), Unter Altstadt 28 Mercandor, 6300 Zug, Switzerland;
- "Customer" shall mean any person or persons, firm or company who buys or agrees to buy goods from the Company;
- “Account” means the registered customer account required to purchase Products or to view orders and invoices;
- “Product(s)" means the products described on the online shop and in the invoice/order confirmation sent by Edelweiss DR;
- “Site” means the website at www.edelweissdr.com;
- “Terms” means these terms and conditions.
2. Applicable Conditions
These Terms and Conditions shall apply to all Edelweiss DR’s Customers, who are invited to review the Terms carefully. Edelweiss DR may update the Terms at any time without notice to the Customer directly.
3. Customer Account
3.1 In order to purchase Products or access certain functions from this Site, the Customer will be required to create an account by providing certain information relevant to delivery, invoicing and payment purposes and by creating a password (the “Account”). The Customers is responsible for providing complete, current and accurate information and for keeping that information up to date.
3.2 In case of shipment of an order to an incorrect address due to inaccurate details on the Customer Account, Edelweiss DR reserves the right to charge the Customer any incurred extra-costs for delivery.
3.3 Any entity subject to VAT has an individual identification number issued by the tax authorities and is responsible for including this information accurately in the Customer Account. Edelweiss DR reserves the right to charge the Customer any costs incurred by the invalidity of the identification number provided.
3.4 The Customer is also responsible for safeguarding the confidentiality of the username and password which are used to access the Account on the Site and is invited to immediately notify Edelweiss DR of any unauthorized use of the personal Account.
Edelweiss DR respects the Customer’s privacy and is committed to safeguarding it.
4. Order Process
4.1 To place an order, the Customer is invited to follow the procedure available on the Edelweiss DR Site and to supply certain information applicable to the purchase, including, without limitation, payment and other information. Any such information will be treated strictly confidentially and for the sole scope of the indicated order. All details provided to the Company or our third party payment processor must be accurate, current and complete.
4.2 By placing an order, the Customer binds himself and formulates to Edelweiss DR a firm and final commitment to buy the selected goods, on the conditions indicated on the Site.
4.3 The Customer will also be responsible for paying any applicable taxes and custom duties relating to the purchases. Verification of information applicable to a purchase may be required prior to acceptance of any order.
4.4 Some Products shown or described on this Site may not be available or not be regulatory cleared, released or licensed for sale in all markets.
5. Prices and Payment of Orders
5.1 Prices are quoted in Euro currency and are not including VAT or shipping costs. Unless agreed by separate contract, the Company reserves the right to amend those prices at any time in its absolute discretion and to correct clerical errors or omissions.
5.2 Unless specifically agreed otherwise, payment is due at order placing by credit card and the Customer is responsible for any transaction charges.
5.3 If the Customer fails to make any payment on the due date then, without prejudice to any other right or remedy, Edelweiss DR shall be entitled to:
- suspend any further deliveries to the Customer;
- indemnification against expenditure on all costs of recovery, including without limitation legal fees, costs and disbursements reasonably incurred.
6. Delivery
6.1 Edelweiss DR shall make every effort to despatch the orders within 5 working days, pending specific product availability and excluding customized orders.
6.2 If a parcel is returned by the carrier following an unsuccessful delivery independent from the Company responsibility, Edelweiss DR shall be entitled to claim for the incurred extra shipping costs.
7. Returns and Exchanges
7.1 Returned Products shall be accepted for credit within 30 working days from date of delivery, prior written notice to the Company by e- mail at info@edelweissdr.com
7.2 The purchase price for returned Products shall be refunded by the Company on the same payment method or credited to the Customer account.
7.3 Returned Products shall only be accepted for credit or exchange if the Products are in a readily saleable condition, unused and in original packaging.
7.4 Returned Products lost or damaged in transit to Edelweiss DR will not be credited.
8. Defective Products
8.1 Return of defective Products shall be accepted, prior written complaint to the Company by e- mail at info@edelweissdr.com
8.2 In case the Complaint is accepted, the Products shall be replaced at the Company expense or refunded on the same payment method or credited to the Customer account.
8.3 The Company shall be entitled to refuse a complaint if the returned Products has been used more than for the reasonable amount of testing purposes.
9. Liability
9.1 The Company shall only be liable towards the Customer for wilful intent or gross negligence.
9.2 The Customer shall be responsible for applying the purchased Products following the Instruction for Use provided by the Company.
10. Governing Law
These Terms shall be governed in all respects by the laws of Switzerland and shall be subject to the jurisdiction at the Court of Justice of Switzerland.
